TERMS & CONDITIONS
1. Live Bidder Registration & Preview: This public auction will be conducted by live auction at 5025 Hwy. 71 West, LaGrange, Texas 78945. All bidders are required to report to the bidder’s table prior to the sale to receive their bidder’s card. All first time buyers must give a $1, 000.00 refundable deposit to bid or a bank letter of guarantee with a statement of limits. Live Registration will be available on Tuesday, April 24, 2012 from 9 am to 4 pm & Auction Day, Wednesday, April 25, 2012 from 8 am until the sale is complete. The complete Terms and Conditions will be provided at the registration table and will be required to be signed by all buyers entering the auction location.
2. Camera, Camera Phones or Video Cameras: The use of cameras, camera phones, or video cameras will not be permitted on Baker Hughes premises.
3. Auction Site Entry: Photo Identification required in the form of a driver’s license, passport or state identification card. No children under the age of 17 and no pets will be allowed on the auction premises. All buyers attending the auction site before, during and after the auction shall be deemed to be there at their own risk. All persons entering the sale site for preview, auction day and removal will be required to sign a hold harmless agreement. No auction participants, employees and or guest shall have any claim against the Auctioneers or Baker Hughes, their representatives, employees, or principals for any injuries sustained, nor for any damages to or loss of property that may occur from any cause of any kind. Lemons Auctioneers and Baker Hughes reserves the right to refuse the issuing of a bidding card and entry.
4. Payment: All bidders must complete payment on the day of the auction by 5:00 p.m. regardless of when picked up.
5. Settlement: Settlement must be tendered in the form of cash, cashier’s checks (will be verified), wire transfer, all major credits, or approved check (with bank letter). All bank Letters must be received no later than 3:00 p.m. Tuesday, April 24, 2012, via fax, e-mail, or in person. No exceptions will be made and all bank Letters will be verified. Bank letters may be emailed to lemons@lemonsauctioneers.com.No merchandise will be released from the auction premises until full payment has been received by Lemons Auctioneers. This will be strictly enforced.
6. Checks or Cashier’s Checks: All cashier’s checks or approved checks must be payable to Lemons Auctioneers, LLP. All cashier’s checks will be verified.
7. Buyer’s Premium: A 10% buyer’s premium will be applied to buyers’ total purchases.
8. Warranties: ALL ITEMS ARE SOLD “AS IS” AND “WHERE IS” WITH NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BIDDERS MUST INSPECT THE EQUIPMENT BEFORE BIDDING.
9. All sales are final. The bidder is responsible for knowing which merchandise he is bidding on. BakerHughes and Lemons Auctioneers, LLP. will not be responsible for supplying batteries, tires or tire repair, fuel, propane tanks, repairs on vehicles, trucks or heavy equipment, a wrecker or trucking services.
10. Removal: All buyers or buyer’s representatives must have a copy of their paid receipt available at the time of removal. Removal will be by appointment only. Buyers using a wrecker or trucking service must supply Baker Hughes or Lemons Auctioneers, LLP. With a signed letter of authorization and a copy of the paid receipt. A letter of authorization may be found on Auctioneers website at www.lemonsauctioneers.com. All merchandise must be removed no later than 3:00 p.m. Friday, May 4, 2012. All abandoned merchandise not removed by 12:00 p.m. (noon) Friday, May 11, 2012 will revert back to Baker Hughes and will be disposed of as Baker Hughes sees fit.
11. There will be absolutely no trading or sales between buyers on the premises of Baker Hughes.
12. Information and photos were gathered from sources considered to be reliable and is believed to be correct. However, no guarantee is provided with respect to such information or photos. Items listed on this brochure are subject to change. All announcements on auction day take precedence over all other printed media or advertisements. All times in this Agreement are specified in Central Daylight Time. This Agreement will be governed by the laws of the State of Texas.
